FAQs / COVID-19 / Should I Select a Realtor Familiar with the Probate Process?

Should I Select a Realtor Familiar with the Probate Process?

Yes, you should select a realtor familiar with the probate process. Arranging a closing for a property going through the probate process requires more legwork than a typical sale.

It’s important that a realtor understand the basic requirements of the probate process and work closely with the title company and probate attorney to coordinate a successful closing.  Often an order authorizing sale from the probate court needs to be obtained, and warranty deeds from all the beneficiaries, assuming the residence was the decedent’s homestead.

These requirements do not present terrible complications for estate with only 2 or 3 beneficiaries, but can create significant delays for more complicated estates with numerous beneficiaries, especially if they live in different states, or out of the county.  It’s important for a realtor to understand the timeline and potential delays that can materialize during the probate process.  As a result, investors are typically the best buyers for probate properties.

How an Experienced Probate Attorney Can Help

The assistance and guidance of an experienced probate attorney can make the process a lot less burdensome on yourself and your family. As you uncover outstanding assets, your probate lawyer can assist in creating an accurate accounting of the deceased’s assets and liabilities and help you submit the documentation necessary to comply with state probate laws.

For assistance with this and any other probate matter in Florida contact the Florida Probate Firm to arrange a free consultation with an experienced Florida probate and estate planning attorney.
